SHIMFIDA:
Cigaban da aka samu –mai yawa- a fannin ilimin kimiyya da fasaha ya yi sanadiyyar sauyawan abubuwa masu yawa da aka sani a da, kaman yanda ya furzar da abubuwan da babu wanda ya taba tunanin cewa za su iya faruwa, wannan abu kuwa ya shafi fannonin: zamantakewa, da ilimin sadarwa, da kuma ilimin likitanci. A shekarun baya-bayan nan ne ilimin likitanci ya kawo wani gagarumin sauye - sauye a bangaren haihuwa, inda –a karon farko- duniya ta fara jin kalmomi irin su: “Hayar mahaifa” da “Bankin sayar da maniyyi” da “mahaifar kwalba” da “Istinsakh” (wato samar da jariri ba ta hanyar miniyyin namiji da mace ba) ko “colony” a Turance, da sauransu.


Duk da cewa asalin wadannan abubuwa sun faru ne a kasashen da ba na Musulmi ba, sai dai cikin gaggawa suka tsallaka zuwa kasashen Musulmai, wasu kuma Musulman suka fara tsallakawa zuwa kasashen da ake yin wadannan ayyuka a asibitocinsu domin a yi masu irin wadannan ayyuka. Wannan ya sanya mutane masu tsoron Allah da kiyaye hukuncin addini suka fara tambayar hukuncin addinin Musulunci game da wadannan abubuwa da suka shigo sakamakon cigaban Bil’adama a wadancan fannoni da muka ambata; malaman Musulunci sun yi bincike masu yawa, an kuma yi tarurruka mabambata; domin nemo hukuncin Shari’ar Musulunci game da wadannan abubuwa, an kuma sami nasara kwarai a kan haka..
A zato na a baya –kafin wannan rubutun- al’ummar mu masu magana da Hausa ba su bukatar irin wadannan mas’aloli na Shari’a, ko kuma ince: ba su ne suka fi muhimmanci ba a wannan lokacin, sai dai na gane kuskuren wannan zaton, a lokacin da wani bawan Allah yake ba ni labarin cewa ana amfani da wannan cigaba na zamani har a kasar Hausa. Gaskiya na kwana cikin tunani, ina mai sake binciko litattafan da malamanmu suka rubuta, suka kuma karantar da mu game da “Sababbin mas’aloli na Fiqhu da suke faruwa a wannan zamanin”, sai na kuma ga ya kamata in yi aikin da nake jin dadinsa matuka a rayuwata, wato kasancewa “hadimin ilimi da malamai”, saboda haka –in Allah ya yarda- zan yi magana –a takaice- game da mas’alolin: “Hayar Mahaifa” da “Sayar ko Kyautar da Maniyyi ko Kwayoyin Halitta”.

MA’ANAR HAYAR MAHAIFA” DA “SAYAR KO KYAUTAR DA MANIYYI KO KWAYOYIN HALITTA”
1/  Ma’anar Hayar Mahaifa:
Idan aka fadi kalmar “hayar mahaifa” ana nufin: daukan kwayoyin halitta daga cikin miniyyin mace, a hada su da maniyyin mijinta, sannan a shigar a cikin mahaifar wata macen daban, inda ita kuma za ta cigaba da rainon cikin har zuwa haihuwa, bayan haihuwa kuma ta mika yaron ga ma’auratan, ma’ana: masu kwayoyin halitta da maniyyin, a asali wannan aikin na hayar mahaifa ana yin sa domin a sami kudi, amma zai yiwu a yi shi ta hanyar bayar da mahaifan kyauta..
Wannan aikin yana da surori biyu:
1 - Zai iya zama macen da aka hayi mahaifar ta kasancewa ba kishiyar mai kwayoyin halittar ba ce, ma’ana wata mata ce ta daban, ba ta da wata dangantaka ta aure da namijin mai maniyyin.
2 - Zai iya zama macen da aka hayi mahaifar ta kasancewa kishiyar mai kwayoyin halittar ce, ma’ana mijinsu daya.

2/  Ma’anar Sayar ko Kyautar da Maniyyi ko Kwayoyin Halitta:
A wannan mas’alar ba mahaifa ake haya ba, a’a, za a dauko kwayoyin halitta daga maniyyin wata mace daban ce, a hada da maniyyin namiji, a shigar a cikin mahaifar matarsa.
Shi ma yana da surori biyu:
1- Zai iya zama macen da aka dauko kwayoyin halittar daga maniyyinta ta kasancewa ba kishiyar wanda aka sanya a mahaifar ta ba ce, ma’ana kwayoyin halitta an ciro su ne daga maniyyin wata macen ta daban da babu alakar aure tsakaninta da mijin mai mahaifar.
2- Zai kuma iya zama macen da aka dauko kwayoyin halittar daga maniyyinta ta kasance kishiyar wanda aka sanya a mahaifar ta ce, ma’ana mijinsu daya.
3/  Dalilan da Suke Sanya a Aikata Haka:
Dalilan da suke sanya a bi wadannan hanyoyi suna da yawa, alal misali: macen da aka cire mata mahaifa saboda wata lalura, amma kuma kwayoyin halitta da suke cikin maniyyinta suna nan da lafiyarsu, ko kuma ya zamana akwai wani aibi mai tsanani a cikin mahaifarta, ko kuma ya zamana daukan ciki yana yi mata wahala matuka, abin da yake sanadiyyar kamuwa da rashin lafiya mai tsanani, ko kuma ya zamana so take ta kiyaye lafiyan jikinta da kyawonsa, zai kuma yiwu shi ma mijin nata yana son haka, ko kuma tana tsoron wahalhalun ciki da haihuwa.
Haka ma a cikin dalilan da suke sanya wa a aikata haka, idan kwayoyin halitta  na maniyyin matar suka sami matsala, ko ya zamana suna da raunin da ba za su iya samar da da ba, ta kuma yiwu maniyyin mijin ne yake da wata matsala, da dai dalilai masu kama da haka..
Duka wadannan dalilai sun hadu sun sanya an sami wasu mata da suke bayar da hayar mahaifansu ga masu bukata, da kuma mata da maza masu sayar da maniyyinsu, ko kwayoyin halitta da suke cikin maniyyinsu..
Wadannan mas’aloli sababbi suna bukatar a bayyana hukunci Shari’ar Musulunci game halaccin haka, ko rashin halaccinsa, sannan kuma idan ya faru wane za a bai wa dan da aka haifa ta wadannan hanyoyi.
A bayani nag aba za mu kawo hukuncin hakan tare da dalilai insha Allah…

Sunnonin alwala: wanke hannaye izuwa tsintsiyar hannu yayin farawa, da kurkure baki, da shaka ruwa, da fyacewa, da dawo da shafar kai, da shafar kunnuwa, da sabunta ruwa dan shafar kunnuwa, da jeranta farillai.

Imam shafi'i kuma ya tafi akan cewa wajibine ka hada da alayensa. Sannan kuma akwai addu'o'in neman tsari da wuta da kuma Dujjal ga wanda Allah yaba ikon haddacesu.
